In Lancashire, a private developer faced a race against time to secure land rights for a 30MW battery energy storage system (BESS). With outline planning permission already in place for the substation, underground cabling, and associated infrastructure, the challenge lay in navigating a complex landscape; both legally and environmentally. A third-party landowner was involved, easement values needed to be agreed upon, and the presence of protected woodland and a country park meant standard engineering solutions wouldn’t cut it. BTS Property Consultancy took the lead, securing an Option Agreement with the local authority and carefully negotiating Heads of Terms for the Easement. Every detail of the Deed of Easement was scrutinised in collaboration with solicitors to ensure maximum risk mitigation for the client. With alternative engineering solutions explored to overcome environmental constraints, we structured an agreement that met the needs of all stakeholders while keeping the project firmly on track. The result? The delivery of a 30MW BESS in line with planning permissions and development agreements, paving the way for a key contribution to the Council’s climate change policy. By combining strategic negotiation with technical expertise, we unlocked the potential of this former brownfield site, helping to future-proof local energy infrastructure.
