With the changes brought by the Building Safety Act 2022 and the latest UK Finance guidance around New Build Warranties (and if you’re borrowing OR lending, you should give that a read), we’ll hopefully start seeing fewer completed schemes where developers neglected to buy a suitable building warranty. But for now, I’m still seeing quite a few… I wrote this article a while back highlighting some of the situations where a Building Warranty (also known as Latent Defects Insurance) should be a non-negotiable. Since then, I’ve noticed a few recurring oversights from developers and investors: ❌ “It’s commercial, not residential, so we didn’t buy it.” ❌ “It’s a conversion, not new build, so we didn’t think we needed it.” ❌ “It’ll be built well, so we obviously won’t need one.” ❌ “We’ll just buy it later if it comes up.” ❌ “It was in good nick, so we skipped the structural engineer’s report.” ❌ “We don’t have site inspection reports because the sign-off is enough.” ❌ “We bought the cheapest one to tick the box.” If you’ve got questions and you'd rather talk it through with a person, get in touch.
